Erosion & Sediment ControlWhat is NPDES?

EPA’s Pollutant Discharge Elimination System (NPDES) storm water program requires the owners or operators of construction sites to obtain a NPDES construction storm water permit. The permit program consists of two phases. Phase I applies to sites that disturb one acre of land or greater. Phase II covers any sites smaller than one acre that are part of a larger common plan of development or subdivision. General permit requirements include the submission of a Notice of Intent and the development of a storm water pollution prevention plan (SWPPP). The SWPPP is a comprehensive plan to control and minimize the release of any pollutants including sediment and hazardous materials through stormwater discharge. Once the SWPPP is developed and the site begins construction, the SWPPP must be enacted on the site and the control measures described in the plan installed on the site. During construction, detailed maintenance and inspection logs are required to be filed in the SWPPP in addition to the actual maintenance and repair of the construction site Best Management Practices (BMPs) or installation of additional practices. These BMP must be continually monitored for their effectiveness and maintained until the site is completed and any disturbed areas are permanently stabilized.
